What to Expect
Caucus model of mediation: Our mediations usually start with a joint session where parties, counsel and principals sit together, sign a confidentiality agreement, discuss the salient issues in the matter and create an agenda for the day. Thereafter the parties retire to private rooms, with the mediator moving between the rooms to advance the negotiation process. I am quite flexible with this model.
Confidentiality Agreement: The parties are asked to sign an agreement expressly bringing the mediation under the umbrella of statutory protections for matters in mediation. Confidentiality may continue past the day of the actual mediation for any follow up necessary to resolve the case. You will be provided a copy of the signed confidentiality agreement upon request.
Comfort: Mediation is a time for problem solving not confrontation. Every effort will be made to avoid escalation of the conflict, while constructively engaging the parties in their dispute.
